These terms govern the use of HubPMS, a software service provided by Mirage Global Technologies LLC, 1621 Central Ave #8434, Cheyenne, WY 82001, United States ("we", "the provider").
HubPMS is a property management system offered as a subscription. The seller of record for every subscription is Mirage Global Technologies LLC. Prices and the modules they include are always shown before activation. Your package price is fixed for the current billing period; price changes take effect only at a renewal and only after at least 30 days' prior notice, so you can cancel before any new price applies.
HubPMS synchronizes rates, availability and bookings with third-party platforms (OTAs) whose systems we do not control. We work hard at speed and reliability, but we do not guarantee uninterrupted availability of the service or of any synchronization, and no service level agreement applies unless separately agreed in writing. Third-party platforms may delay, reject or misprocess updates for reasons outside our control, and we are not responsible for their APIs, their outages or their policies. You remain responsible for monitoring and verifying your own inventory, rates and bookings, including during any outage, and for any relocation costs or platform penalties arising from inventory you did not verify. Tools like the Overbooking Guardian help you do this; they do not replace your supervision.
When your property accepts payments from its guests through a connected payment account (for example your own Stripe account), you are the merchant of record for those transactions. Mirage Global Technologies LLC is not a party to the transaction between you and your guest, does not hold or control those funds, and is not responsible for refunds, chargebacks or the tax obligations of your sales. Your relationship with the payment provider is governed by that provider's own terms, and you may revoke the connection at any time from your settings or from the provider's dashboard.
For personal data of your guests processed inside HubPMS, you (the property) act as the data controller and Mirage Global Technologies LLC acts as a data processor on your documented instructions. The Data Processing Agreement (Art. 28 GDPR) forms part of these terms for properties subject to the GDPR.
The free trial runs 5 days on one property with up to 50 rooms and 2 live channels, with no card required. When a trial ends, live channel connections are disconnected and the workspace becomes read-only for 30 days before deletion. Paid subscriptions renew monthly and can be cancelled at any time, effective at the end of the paid period. Your data can be exported at any time. The 30-day read-only window applies at the end of a trial; for closure of a paid account, deletion follows §8 of the Data Processing Agreement. Taxes: prices are stated exclusive of any applicable VAT or sales tax unless the checkout states otherwise; where you provide a VAT number, you are responsible for its validity, and reverse-charge treatment applies only to validly registered businesses.
We may suspend or, for continued cause, terminate access where: an invoice remains unpaid 14 days after a reminder; the service is used unlawfully or to harm third parties; you attempt to access other tenants' data or to circumvent security; or continued operation would create a security risk. Where reasonable we warn first and suspend before terminating. Suspension for non-payment never deletes your data before the read-only window in §5 has run.
You agree not to abuse the service, attempt to access other tenants' data, or resell access without an agreement. We keep immutable audit logs of operator actions, including any support access to your workspace.
The HubPMS software, site and documentation remain the property of Mirage Global Technologies LLC. Your data remains yours: we claim no rights over your property content, guest records or business data beyond what is needed to operate the service, and you can export it at any time.
The service is provided with reasonable skill and care. To the extent permitted by law, we are not liable for indirect or consequential damages, including lost profits, lost revenue, lost data or platform penalties, and our aggregate liability is limited to the fees you paid in the twelve months before the claim. Nothing in these terms excludes liability that cannot be excluded by law, including for wilful misconduct or gross negligence.
We may update these terms with at least 30 days' notice by email for material changes. If you do not agree, you may cancel before the change takes effect; continued use after the effective date is acceptance.
These terms are governed by the laws of the State of Wyoming, United States, excluding its conflict-of-law rules, and the courts located in Laramie County, Wyoming have exclusive jurisdiction — except that, where you are a consumer under mandatory law of your country of residence, nothing in this clause deprives you of the protection of those mandatory provisions or of your local consumer forum.
